The Second Edition has arrived! Completely redone to answer the questions people ask the most, including how to defend against original creditors and how to sue debt collectors who have harassed you, among many other improvements.
The secret to defending yourself against debt collectors is understanding the economic realities that drive these cruel, greedy companies. And to know how to use the legal system to exploit their weaknesses and defend yourself. The Litigation Manual will educate you on the debt collection process, tell you about your rights, and show you how to protect yourself. It tells you what to expect in court the first day, what to expect from the debt collectors, and how to take charge of the process to find what you need to know.
The Litigation Manual tells you everything you need to defend yourself from a lawsuit brought by third-party debt collectors. In language anybody can understand and use. Gives you the knowledge and motivation to fight the debt collectors and safely navigate the court system. Good for any jurisdiction. Used with the Forms Package, prepares you to go in and win.
Here's what one satisfied user said (unsolicited and uncompensated):
Ken, Just a quick email to say THANK YOU for your well written manual! I was scared to death when I got a summons and Complaint served on me by a debt collection attorney in Nov. I did exactly what you said, though, and basically let them know I wasn't going away. The key, I believe, was in the Interrogatories (I used the exact same ones in your manual). They wouldn't answer them, even after my motion to compel. So I filed a Motion to Dismiss, and that was pretty much it. The attorney folded like a cheap suit, and I have to say it almost felt better than sex! Thanks again! --Gary

The information in my Litigation Manual is NOT widely available and is not available anywhere for less than I am charging, as far as I know. It comes from the trenches, you might say. I wrote it all myself, taking many, many hours of my time to do it. The materials and strategies are battle-tested from many different lawsuits over time, so you can know they work. You might find it interesting even if you are not being sued, but it is not intended as a textbook. It is intended as a tool to help you get rid of debt collectors who are suing you.
The Litigation Manual is in ebook form and over 150 pages long, not including the appendixes. I tried to keep it as short as possible while still giving you all the information you were likely to need. Debt litigation is not as complicated as a lot of kinds of cases, but there is stuff you need to know, and stuff you need to understand, to be fully prepared.
The Manual explains the debt collection process, a process that begins long before the collector files suit and does not end until the collector either dismisses the case “with prejudice,” as I will teach you how to force it to do, or takes a lot more money away from you than you ever owed. Which is what happens to most people who do not defend themselves. That won’t be you with my Manual.
The Manual also explains the legal process, what it means to be “served” with the lawsuit, what the petition is, how to answer it, where you go, and how you act. It explains and shows you how to move towards a possible trial in a position to win.
See, most lawsuits never actually go to trial. As it becomes clear either that you can win the lawsuit, or that the debt collector can’t win the suit without spending a lot of money, the cases usually get dropped. They don’t want to waste a lot of money. To them, pretty much all you are is a way to make (or lose) money. If you show them that pursuing your case will lose them money, there’s a good chance they will drop it. And even if they don’t, you’ll be ready for that, too. My Manual should have you ready for either situation. Click here to see the Table of Contents.
The Manual will get you comfortable and familiar with court, so you know what to expect. It gives you forms that you will understand and know how to change to fit your needs–because this is not a “one size fits all” situation. And in general I try to fill you in on all the possible pitfalls and tricks of the lawyer whose working against you. I can’t tell you all the tricks you might see, but I can prepare you enough to handle them.
And I tell you about some of the ways you might strike back–through the Fair Debt Collection Practices Act, for example, and there are other ways, too.
